A. Costs Estimate For Trade Marks Application in PRC
(for one trade mark up to 10 designated goods/services per class & for simple straightforward application)

Ⅰ. SEARCH 查詢（Optional 非必須的）

Availability search ：綜合的查詢及報告
a) Words search 字型查詢 $300 $39
b) Logo search 圖案查詢 $600 $78

(Fees consists of instructing our associate/agent to conduct the search at the Trade Marks Registry, reviewing and reporting the search results with advice on registration)
申請前查詢的作用是找出類似或相同并對申請有影響的已申請/注冊的商標。
此費用包括在商標注冊署進行商標查詢﹑分析和報告查詢結果以及提供建議。

Ⅱ. FILING OF APPLICATION (for one trademark one class) 申請 費用 $3,800 $494
(for one trademark one class以一個商標一個類別計算)

(Fees consists of preparing and handling of the required Power of Attorney Document, instructing our associate/agent to filing the application and reporting the status of filing particulars, acceptance and advertisement of the application (for opposition purposes),publication and registration fees, obtaining and forwarding the Certificate of Registration.)
Validity: TEN (10)years.
此費用包括準備和處理必需的授權書文件、協(xié)助申請人選擇申請類別、準備和提交申請、繳付官方費用以及報告申請資料、報告公告的許可通知、辦理公告事宜、報告獲準注冊通知、領取及寄上注冊證書以及繳付官方費用。
Validity : TEN (10) years 有效期為十年。

Ⅲ .MISC. ( Additional Service Charges 額外服務)

a) Drafting, Amending and Filing Arguments申辯費用
( simple argument per case) 簡單申辯 3，000 $390
The argument fees may be adjusted based on the complexity of the cases, -$10，000 -$1，299
separate quotation will be issued for cases involving court proceeding.
此費用只限于一般申辯及會因為案件的復雜程度而有所調整。
另涉及法院程序的案件會根據(jù)個別律師的費用而定，我方將會預先通知。

b) Renewal 續(xù)期 （for 10 years） 有效期為十年

Preparing and executing the Assignment document. For Assignment without goodwill, additional advertising is required.

B． Procedure for applying trade mark registration 商標注冊申請的程序
Ⅰ.A word, logo or both, which is distinctive, can be applied for trademark registration.
任何具顯著性的文字﹑圖案或文字加圖案的標記均可申請注冊。

Ⅱ. An availability search is usually recommended to find out whether there is any similar or identical filed/registered marks which may bar your application. After the search, the filing of the mark will be applied in the specified class with up to 10 designed goods or services. There are totally 45 classes. The fees for trademark application is for 10 years and the trademark could be renewed every 10 years.
申請前查詢的作用是找出類似或相同并對申請有影響的已申請/注冊的商標。查詢后再分類為最多十項指定物品或服務，總共有45類。費用為有效期十年。之后可在到期日或之前，續(xù)期十年。

Ⅲ. After the filing of the application, the Registry will examine the mark in the application. If the application fulfills the requirement, then the application will be granted by the examiner and the Registry will require the applicant to advertise the trademark. If no opposition to the application is filed in 3 months time, the Registry will grant the application and issue the certificate. The time span from filing to obtaining a trademark will normally take approximately 14-18 months.
提交申請后，商標注冊署審查員會對申請作出審查。如申請合乎商標法條例及沒有抵觸其他注冊或已申請注冊的商標，注冊署會發(fā)出公告許可證及列明商標獲準注冊所須遵辦的條件。如在公告日期起計之3個月內沒有人提出反對，申請人將于14至18個月后便可申領注冊證書。
